PRODUCERS:

• Must be a GROWER member in current standing of the North Dakota Farmers’ Market & Growers Association (NDFMGA).
• Must be a producer and or grower of North Dakota produce and/or processed products.
• Must be used only on products that are produced and/or processed in North Dakota

FARMERS MARKETS:

• Must be a North Dakota FARMERS MARKET member in current standing of the North Dakota Farmers’ Market & Growers Association (NDFMGA).
• May be used to promote the farmers’ market and local grower industry

RETAILERS, RESTAURANTS & WHOLESALERS:

• May be used to merchandise and promote locally-grown produce produced from members of the NDFMGA.

SUPPORT ORGANIZATIONS:

• GOLDEN members that agree to help promote and encourage the development of local producers and the NDFMGA.

Improper logo use
Improper use includes:

• Use on products not produced and/or processed in whole or in part within the boundaries of North Dakota
• Allowing use of the logo by another person who is not a member
• Using the logo without membership to the NDFMGA.
• Any use that may be determined as detrimental to the promotion and well-being of the North Dakota Farmers’ Market & Growers Association and the local grower/producer industry.

Civil action
When an investigation reveals improper use of the logo is occurring or has occurred, NDFMGA may seek injunctive relief or seek to apply other appropriate legal remedies in a court of competent jurisdiction.

No warranty of quality
Membership or use of the logo does not represent a warranty by NDFMGA of any kind, expressed or implied, about the quality of the product on which the logo appears. Membership and right to use the logo means only that the product has been approved to use the logo as a product that was produced and/or processed by a GROWER member of the NDFMGA within the boundaries of North Dakota.
